Terms of Service

Welcome to Olane Brand ("Olane," "we," "our," or "us"). These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," "user," or "customer") and Olane Brand, and govern your access to and use of our website at https://olane-brand.com (the "Site"), as well as the purchase of any products or services offered through the Site (collectively, the "Service").
By accessing the Site, browsing our products, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated by reference.
If you do not agree with any part of these Terms, you must not use the Site or place an order with us.
1. Definitions
For the purposes of these Terms:
- "Account" means a registered customer profile created on the Site.
- "Content" means any text, images, reviews, comments, photographs, video, or other material submitted, uploaded, or posted by users.
- "Order" means a request submitted by you through the Site to purchase one or more products.
- "Products" means the goods listed for sale on the Site from time to time.
- "Force Majeure Event" has the meaning set out in Section 18.
2. Eligibility and General Conditions
2.1. The Site is operated by Olane Brand from Hong Kong SAR.
2.2. To use the Site or place an Order, you must:
- be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater;
- have the legal capacity to enter into a binding contract; and
- not be barred from receiving the Service under the laws of Hong Kong or any other applicable jurisdiction.
2.3. By accepting these Terms, you represent and warrant that you meet the eligibility requirements above. If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2.4. We reserve the right, in our sole discretion, to refuse service, terminate accounts, cancel orders, or restrict access to the Site to any person, at any time, for any lawful reason.
2.5. You agree not to reproduce, duplicate, copy, sell, resell, scrape, frame, mirror, or commercially exploit any portion of the Site, the Service, or its content without our prior express written permission.
3. Account Registration
3.1. Certain features of the Site may require you to create an Account. You agree to provide accurate, current, and complete information and to keep it updated.
3.2. You are responsible for safeguarding your login credentials and for all activity that occurs under your Account. You must notify us immediately at support@olane-brand.com if you suspect unauthorised use.
3.3. We are not liable for any loss or damage arising from your failure to comply with this section.
4. Products and Product Information
4.1. We make reasonable efforts to display product details, descriptions, materials, dimensions, colours, and prices accurately. However, we do not warrant that product descriptions, images, or other content on the Site are error-free, complete, or current.
4.2. Colours and finishes shown on screen may vary slightly from the actual product due to monitor settings, lighting, and natural variation in materials.
4.3. All Products are subject to availability. We reserve the right, at any time and without prior notice, to:
- modify, discontinue, or restrict any Product;
- correct errors, inaccuracies, or omissions; and
- update Product information (including pricing) without obligation to notify users who have already placed an Order, except where required by law.
4.4. The display of any Product on the Site is an invitation to treat and not an offer to sell.
5. Pricing and Payment
5.1. All prices are listed in Hong Kong Dollars (HKD) unless otherwise stated, and are exclusive of any applicable taxes, duties, or shipping fees, which will be itemised and shown clearly at checkout before you confirm your Order.
5.2. We reserve the right to change prices at any time without prior notice. Confirmed Orders will be honoured at the price displayed at the time of Order acceptance.
5.3. Price transparency. The price you see on a Product page is the price you pay for that Product. We do not add any mandatory fees, charges, or upsells at checkout that increase the total price beyond shipping, applicable taxes, and government-mandated duties. Prices, availability, and Product information shown on third-party platforms (including Google Shopping, social commerce channels, and search results) are intended to match the prices shown on the Site. If any discrepancy occurs, the price displayed on the Site at the time you place your Order will apply.
5.4. We accept the following payment methods: Visa, Mastercard, American Express, PayPal, Shop Pay, Google Pay, Apple Pay, and UnionPay.
5.5. Secure checkout. All payment and personal information is collected through pages secured by a valid SSL/TLS certificate (HTTPS). Payments are processed by trusted PCI-DSS-compliant third-party payment providers. By placing an Order, you authorise us (or our payment processor) to charge your selected payment method for the total amount of the Order, including any taxes and shipping fees.
5.6. We do not store full credit or debit card details on our servers.
5.7. We collect only the personal and payment information that is necessary to process your Order, deliver your Products, and provide customer support, in accordance with our Privacy Policy.
5.8. If your payment is declined or reversed for any reason, we reserve the right to suspend or cancel your Order.
6. Order Acceptance and Cancellation
6.1. All Orders placed through the Site constitute an offer by you to purchase Products subject to these Terms.
6.2. An Order is only accepted, and a binding contract of sale formed, when we send you a shipping confirmation email. An order confirmation email acknowledging receipt of your Order does not constitute acceptance.
6.3. We may, at our sole discretion, decline or cancel any Order, including (without limitation) where:
- the Product is out of stock;
- there is an error in pricing or product information;
- your payment cannot be processed;
- we suspect fraudulent or unauthorised activity;
- the Order violates these Terms; or
- delivery to your address is not feasible.
6.4. We may limit or restrict the quantity of Products that may be purchased per person, per household, or per Order.
6.5. If we cancel an accepted Order, we will refund any amounts already charged to your original payment method.
7. Shipping and Delivery
7.1. Shipping options, timeframes, and fees are presented at checkout and are also detailed in our Shipping Policy.
7.2. Risk of loss and title to the Products pass to you upon delivery to the carrier.
7.3. While we work with reputable carriers, we are not responsible for delays, damage, loss, or mis-delivery caused by the carrier, customs authorities, or events outside our reasonable control.
7.4. International shipments may be subject to import duties, taxes, and customs fees, which are the responsibility of the recipient.
7.5. You are responsible for providing an accurate shipping address. We are not liable for Orders shipped to an incorrect address provided by you.
8. Returns, Exchanges, and Refunds
8.1. Returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms part of these Terms and is freely accessible on the Site without requiring you to log in or provide any personal information.
8.2. Summary of key terms (the full policy prevails in the event of any inconsistency):
- Return window: Eligible Products may be returned within the period specified in our Return & Refund Policy, calculated from the date of delivery.
- Eligibility conditions: Products must be returned in their original, unused condition and in the original packaging, with all tags attached, unless the item is defective or damaged on arrival.
- How to initiate a return: Contact us at support@olane-brand.com with your order number and reason for return before sending any item back.
- Return shipping: Responsibility for return shipping costs is set out in the Return & Refund Policy.
- Refund processing: Once we receive and inspect a returned Product, refunds are processed back to the original payment method within the timeframe stated in the Return & Refund Policy.
8.3. We do not charge restocking fees on standard returns.
8.4. Nothing in this section excludes any non-waivable consumer rights you may have under applicable law.
9. Intellectual Property
9.1. All content on the Site — including but not limited to the Olane Brand name, logos, trademarks, designs, product images, photographs, illustrations, text, graphics, layouts, and software — is owned by or licensed to Olane Brand and is protected by Hong Kong and international copyright, trademark, and other intellectual property laws.
9.2. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes.
9.3. You may not, without our prior written consent:
- reproduce, modify, distribute, transmit, display, perform, publish, license, or create derivative works from any content on the Site;
- use any data-mining, robots, scrapers, or similar data-gathering tools; or
- use our trademarks, trade dress, or branding in connection with any product or service that is not ours, or in any manner likely to cause confusion.
9.4. All rights not expressly granted to you are reserved by Olane Brand and its licensors.
10. User Content
10.1. By submitting reviews, comments, photos, suggestions, or other content ("User Content") to the Site or our social channels, you grant Olane Brand a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media, for marketing, promotional, and operational purposes.
10.2. You represent and warrant that:
- you own or control all rights in and to the User Content you submit;
- the User Content is accurate, lawful, and does not infringe any third party's rights (including intellectual property, privacy, or publicity rights); and
- the User Content does not contain defamatory, obscene, harassing, hateful, or otherwise objectionable material.
10.3. We reserve the right (but not the obligation) to monitor, edit, refuse, or remove any User Content at our sole discretion.
10.4. You waive any moral rights you may have in the User Content to the extent permitted by applicable law.
11. Prohibited Uses
You agree not to use the Site or its content:
(a) for any unlawful purpose or to solicit others to perform unlawful acts; (b) to violate any international, national, or local regulations, rules, laws, or ordinances; (c) to infringe upon or violate our or any third party's intellectual property rights; (d) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate against any person or group; (e) to submit false or misleading information; (f) to upload or transmit viruses, malware, worms, Trojan horses, or any other type of malicious code; (g) to collect or track the personal information of others; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Site, the Service, or any related website or network.
We reserve the right to terminate your use of the Site for any breach of this section.
12. Business Authenticity and Customer Service
12.1. Who we are. Olane Brand is the seller of all Products listed on the Site. Our registered business name, address, and contact details appear in Section 27 below and are also displayed in the footer of every page on the Site.
12.2. Product authenticity. All Products sold on the Site are described accurately to the best of our knowledge, including materials, dimensions, country of origin (where applicable), and intended use. Product images are representative, and minor variations may occur due to the nature of the materials.
12.3. Customer service availability. Our customer service team can be reached at support@olane-brand.com or +852 9424 3980 during business hours (Monday – Saturday, 09:00 – 18:00 HKT). We aim to acknowledge customer enquiries within two (2) business days and to resolve order-related issues as promptly as possible.
12.4. No misrepresentation. We commit to providing complete, accurate, and non-misleading information about our Products, pricing, availability, and policies on the Site and on any third-party platform on which our Products are listed (including Google Shopping and other comparison or commerce surfaces).
13. Third-Party Links and Services
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Olane Brand. We are not responsible for the content, policies, or practices of any third-party site. Your use of any third-party services is at your own risk and subject to the terms and policies of that third party.
14. Disclaimers
14.1. The Site and all Products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including (to the maximum extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, non-infringement, or those arising from course of dealing or usage of trade.
14.2. We do not warrant that:
- the Site will be uninterrupted, secure, timely, or error-free;
- defects will be corrected;
- the Site is free of viruses or other harmful components; or
- the results obtained from using the Service will meet your expectations.
14.3. Nothing in these Terms excludes or limits any non-excludable statutory rights you may have under applicable consumer protection laws, including those of Hong Kong.
15. Limitation of Liability
15.1. To the maximum extent permitted by law, Olane Brand, its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site, your purchase of any Product, or any breach of these Terms — whether based on warranty, contract, tort, negligence, or any other legal theory.
15.2. Where liability cannot be excluded but may be limited, our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the greater of (a) the total amount you paid to Olane Brand for the Product(s) giving rise to the claim in the three (3) months preceding the event giving rise to liability, or (b) HKD 500.
15.3. The limitations in this section apply even if any limited remedy fails of its essential purpose.
16. Indemnification
You agree to defend, indemnify, and hold harmless Olane Brand, its parent, subsidiaries, affiliates, partners, officers, directors, employees, agents, contractors, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or related to:
(a) your breach of these Terms or any document incorporated by reference; (b) your violation of any law or the rights of a third party; (c) any User Content you submit; or (d) your misuse of the Site or any Product.
17. Termination
17.1. These Terms remain in effect while you use the Site. We may suspend or terminate your access to the Site or your Account at any time, without notice, for any reason — including (without limitation) breach of these Terms.
17.2. Upon termination, all provisions of these Terms which by their nature should survive (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall survive.
18. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including (without limitation) acts of God, natural disasters, pandemics or epidemics, war, terrorism, civil unrest, government action, labour disputes, supply chain disruption, power or telecommunications failures, or carrier delays (each a "Force Majeure Event").
19. Privacy and Data Protection
Your privacy matters to us. Please review our Privacy Policy, which explains how we collect, use, store, and protect your personal information in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and other applicable laws. We collect only the information necessary to fulfil your Order and provide customer support, and we do not sell your personal data to third parties.
20. Governing Law and Dispute Resolution
20.1. These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles.
20.2. The parties shall first attempt in good faith to resolve any dispute through informal negotiation by contacting us at support@olane-brand.com.
20.3. If the dispute cannot be resolved within thirty (30) days, the parties agree to submit the dispute to the exclusive jurisdiction of the courts of Hong Kong SAR, except where mandatory consumer protection laws of your country of residence provide otherwise.
21. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
22. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed by us in writing.
23. Assignment
You may not assign or transfer these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.
24. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies or operating rules posted by us on the Site, constitute the entire agreement between you and Olane Brand and supersede any prior agreements, communications, and proposals, whether oral or written, between you and us.
25. Changes to These Terms
25.1. We reserve the right, at our sole discretion, to update, modify, replace, or revise any part of these Terms at any time by posting the updated version on the Site and updating the "Last updated" date.
25.2. It is your responsibility to review these Terms periodically. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
25.3. If we make a material change, we will use reasonable efforts to notify registered customers by email or through a notice on the Site.
26. Language
These Terms are drafted in English. In the event of any inconsistency between the English version and a translated version, the English version shall prevail.
